1. About us and these terms

This website, artascene.com, is operated by Artascene ("we", "us", "our"), of 52 Ashmore Street, Erskineville NSW 2043, Australia.

These terms apply when you use our website or buy from us. Please read them alongside our Privacy Policy, Shipping Policy and Returns & Refunds policy, which form part of these terms.

The store runs on Shopify, and payments are handled by Shopify and its payment partners.

2. Your rights under Australian Consumer Law

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded. If any part of these terms appears to do so, it doesn't apply to that extent.

3. Using the website

You must be 18 or over, or have a parent or guardian's permission, to place an order.

When using the site, you agree not to:

• break any law, or use the site for anything fraudulent
• use bots, scripts or automated tools to browse, check out or buy products
• scrape, copy or harvest content or data from the site
• interfere with the site's security or operation, or upload malicious code
• impersonate anyone else, or give us false details

If you do any of these things, we may restrict or block your access and cancel related orders, refunding any amount you've paid.

4. Products, colours and descriptions

We try to describe and photograph every piece accurately. Screens display colour differently, so the colour you see may differ slightly from the real item.

Many Artascene pieces are washed, distressed, raw, sprayed or dyed by hand. Variation in fade, texture, distressing and colour from piece to piece is intended, and doesn't make an item faulty.

Measurements are listed in our Size Guide. Each garment may differ from the listed measurements by a small amount.

5. Prices and payment

All prices are in Australian dollars. We're not registered for GST, so no GST is charged. Shipping costs appear at checkout, before you pay.

We may change prices on the site at any time. A price change won't affect an order we've already accepted.

6. Orders, drops and limits

Placing an order is an offer to buy. We accept your order when we dispatch it or send you a shipping confirmation.

Our drops are limited. To keep them fair, we may:

• limit how many of an item, or how many orders, one customer can buy, including by account, payment card, email or delivery address
• decline or cancel orders that appear to come from resellers, bots or automated tools, or that look fraudulent

We may also cancel an order if a product sold out before we could fill it, or if the price or description on the site was clearly wrong.

If we cancel all or part of your order for any of these reasons, we'll tell you and refund what you paid for the cancelled items in full. We will never take payment for an item we know we can't supply.

7. Pre-orders

If an item is sold as a pre-order, its product page will show the expected dispatch date. If we can't dispatch within a reasonable time after that date, we'll let you know and you may choose a full refund.

8. Shipping and risk

Delivery times and costs are set out in our Shipping Policy. Delivery estimates are not guaranteed, but we'll keep you updated if there's a delay. Responsibility for the goods passes to you on delivery.

9. Returns and refunds

We don't offer change-of-mind returns or exchanges, so please check the Size Guide before you order. This doesn't affect your rights for faulty, damaged or incorrect items, which are explained in section 2 and in our Returns & Refunds policy.

10. Our content and intellectual property

Everything on this site belongs to Artascene or the people who licensed it to us, including:

• the Artascene name and logo
• our designs, graphics and prints
• product photos, campaign images and films
• written content

You may share links to our site and repost our social media content with credit. You may not copy, reproduce or sell our designs, images or branding, or use them commercially, without our written permission.

11. Things you share with us

If you tag Artascene or send us photos, videos, reviews or ideas, you give us permission to repost and share them on our website and social channels, with credit to you where we can.

You confirm that you have the right to share that content. We won't sell your content or use it in paid advertising without asking you first. If you'd like something taken down, email us and we'll remove it from our channels within a reasonable time.

12. Links to other sites

Our site may link to other websites, such as Instagram, TikTok, Shopify and payment providers. Those sites have their own terms and privacy policies, and we're not responsible for their content.

13. Our liability

Subject to section 2, we're not responsible for:

• loss caused by your own actions, such as not following care instructions or misusing the site
• loss caused by events outside our reasonable control
• loss that was not reasonably foreseeable

We work to keep the site available and accurate. It may occasionally be unavailable, or contain errors that we fix once we find them.

14. Privacy

How we collect and use your personal information is explained in our Privacy Policy.

15. Changes to these terms

We may update these terms from time to time, for example to reflect new products, services or legal requirements. Your order is governed by the terms in place when you placed it. If we make a significant change, we'll show the new date at the top of this page.

16. Governing law

These terms are governed by the laws of New South Wales, Australia. Any dispute will be handled by the courts of New South Wales.

If you have a problem, please contact us first so we can try to fix it. You can also contact NSW Fair Trading for free help resolving a consumer issue.

17. General

If a court finds part of these terms invalid, the rest of these terms continues to apply. If we don't enforce a term right away, we can still enforce it later.
